Petitioner Alton Coleman has been convicted of murder in an Ohio state court and has been sentenced to death. He now appeals the district court's order dismissing his habeas corpus petition brought pursuant to 28 U.S.C. § 2254. Coleman raises several assignments of error, the most serious of which are: (1) the district court erred when it held that Coleman had procedurally defaulted on 34 of the 50 claims raised in his habeas petition; (2) his constitutional due process rights were violated because of prosecutorial misconduct and the introduction of "other acts" evidence; and (3) he was denied effective assistance of counsel at sentencing because his attorneys failed to fully investigate his background and mental health for purposes of offering evidence in mitigation. For the reasons discussed below, we will affirm the judgment of the district court.
